Article 10

10.1 If your Ticket (or any unused portion) is refundable, in accordance with the applicable fare rules or Tariff, we will make a refund as follows:

10.1.1 Except as otherwise provided in this Article 10, we shall be entitled to make a refund either to the person named in the Ticket or to the person who has paid for the Ticket, upon presentation of satisfactory proof of such payment.

10.1.2 If a Ticket has been paid for by a person other than the Passenger named in the Ticket, and the Ticket indicates that there is a restriction on refund, we shall make a refund only to the person who paid for the Ticket, or to that person’s order. This provision will not apply where Article 9 permits the passenger to receive a refund.

10.1.3 Applicable taxes, fees and charges paid at the time of issue of your Ticket will be included in fare refunds pursuant to Articles 9, 10.2, 10.3 and 10.4, where appropriate.

10.1.4 All refunds are conditional on receipt by us of proof that you are the person named in the Ticket or the person entitled to receive a refund.

10.2 Involuntary refunds

10.2.1 We will pay fare refunds if we:

(a) cancel a flight

(b) fail to operate a flight reasonably according to schedule

(c) fail to stop at your destination or Stopover

(d) cause you to miss a Connecting Flight because of in-flight delay, diversion and sufficient time existed to make the connection between the originally scheduled time of arrival of your flight and the departure time of the Connecting Flight.

We will not pay refunds where you are precluded from boarding in accordance with Article 7.1 or 11.3.

Fare refunds will be calculated as follows:

10.2.1.1 if no portion of the Ticket has been used an amount equal to the fare paid;

10.2.1.2 if a portion of the Ticket has been used, the refund will be not less than the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used.

10.2.2 If we refuse you carriage for any of the reasons set out in Article 7.1, you will not be entitled to any refund for the actual flight for which you were refused carriage but will otherwise be entitled to a refund as set out in this Article 10.2. Apart from this, we will have no liability to you for any loss or expense whatsoever.

10.2.3 If your carriage is terminated by us under Article 11.3 because of your unacceptable behaviour, the amount of your refund will be calculated according to Article 10.2.1 except that no refund will be given in respect of the flight during which your behaviour was unacceptable.  Additionally, we shall be entitled to deduct from any refund due to you an administration fee of no more than £50 as well as any costs due for reimbursement by you under Article 11.3.

10.3 Voluntary refunds

10.3.1 If you are entitled to a refund of your Ticket for reasons other than those set out in Article 10.2, the amount of the refund shall be:

10.3.1.1 if no portion of the Ticket has been used, an amount equal to the fare paid, less cancellation fees and an administration fee of no more than £50;

10.3.1.2 if a portion of the Ticket has been used and there is no restriction on the Ticket then the refund will be an amount equal to the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used, less cancellation fees and any reasonable administration charges.

10.4 Right to refuse refund

10.4.1 We may refuse a refund where application is made after the expiry of the validity of the Ticket.

10.4.2 We may decide to refuse a refund on a Ticket which has been presented to us, or to Government officials, as evidence of intention to depart from that country, unless you establish to our satisfaction that you have permission to remain in the country or that you will depart from that country by another carrier or another means of transport.

10.5 Currency

We reserve the right to make a refund in the same manner and the same currency used to pay for the Ticket.

10.6 By whom ticket refundable

Voluntary refunds will be made only by the carrier which originally issued the Ticket or by its agent if so authorised.
